Overview
These Terms of Service ("Terms") govern your use of the website drkatiebarbaccia.com and your participation in any programs or services offered by Radiant Vitality Collective, LLC, operated by Dr. Katie Barbaccia, ND ("I," "me," or "my"). By accessing this website or enrolling in any program or service, you agree to be bound by these Terms in full. If you do not agree with any part of these Terms, please do not use this website or enroll in any offering.
About our services
Radiant Vitality Collective, LLC offers natural health education and wellness consultation services, including the Energy Reclamation Method (ERM) and The Wild Collective. All services are provided in the capacity of natural health consultation and wellness education and do not constitute the practice of medicine. Please review our Medical and Health Disclaimer for full details regarding scope of practice.
Eligibility
By enrolling in any program or service offered by Radiant Vitality Collective, LLC, you represent that you are at least 18 years of age and legally capable of entering into a binding agreement. You further represent that the information you provide during enrollment and intake is accurate and complete to the best of your knowledge.
State and regional eligibility
Clients are solely responsible for understanding whether naturopathic wellness consultation is permitted in their state or region. By enrolling in any program, you represent that you have confirmed that participation is lawful in your jurisdiction. Radiant Vitality Collective, LLC makes no representation regarding the legality of its services in any specific state or region outside of where Dr. Barbaccia holds licensure.
Enrollment and payment
Payment in full If you choose the pay-in-full option, your enrollment is confirmed upon receipt of full payment. Access to program materials and scheduling of sessions will be initiated following confirmation of payment and completion of your intake process.
Payment plan If you choose the payment plan option, you agree to make all scheduled payments in full and on time as outlined at the time of enrollment. Enrollment is confirmed upon receipt of your first payment. Remaining payments will be automatically charged according to the agreed schedule.
Failed or missed payments If a scheduled payment fails or is not received, you will lose access to the program, including all sessions and program materials, until the outstanding payment is resolved. Radiant Vitality Collective, LLC reserves the right to pursue any and all outstanding payments owed under your enrollment agreement. Failure to complete all payments does not release you from your financial obligation for the full program investment.
Refund policy
All sales are final. Radiant Vitality Collective, LLC does not offer refunds after enrollment, regardless of program usage, session attendance, or personal circumstances. By enrolling, you acknowledge and agree that no refunds will be issued under any circumstances.
If you have questions about whether the Energy Reclamation Method is the right fit for you before enrolling, you are encouraged to book a free discovery call prior to making your investment.
Program pause policy
Under certain circumstances, Radiant Vitality Collective, LLC may allow a client to pause their program. Circumstances that may be considered include but are not limited to medical emergencies, serious illness, or significant life events such as bereavement. Pause requests are evaluated on a case by case basis at the sole discretion of Dr. Katie Barbaccia, ND. A pause is not guaranteed and does not entitle the client to a refund of any payments made. Program transfer policy
Under certain circumstances, Radiant Vitality Collective, LLC may allow a client to transfer their enrollment to a future cohort or program date. Transfer requests are evaluated on a case by case basis at the sole discretion of Dr. Katie Barbaccia, ND. A transfer is not guaranteed, does not entitle the client to a refund of any payments made, and is subject to availability of future program dates. Transfers to another individual are not permitted. Intellectual property
All content created and provided by Radiant Vitality Collective, LLC, including but not limited to program materials, curriculum, session content, written resources, videos, audio recordings, worksheets, guides, and website content, is the exclusive intellectual property of Radiant Vitality Collective, LLC and Dr. Katie Barbaccia, ND, and is protected by applicable copyright and intellectual property law.
By enrolling in any program or accessing any content, you agree that you will not:
- Copy, reproduce, distribute, or share any program materials in any form without express written permission
- Resell, sublicense, or commercialize any content or materials provided through any program or offering
- Use program content to create derivative works or competing offerings
- Share login credentials, session recordings, or program materials with any third party
Any unauthorized use of program content may result in immediate termination of your enrollment without refund and may subject you to legal action.
Client responsibilities
To get the most from your program and to ensure a productive working relationship, you agree to:
- Attend scheduled sessions or provide reasonable advance notice if you need to reschedule
- Engage honestly and openly in the consultation process
- Complete intake forms and any requested materials in a timely manner
- Maintain regular care with a licensed medical provider, such as an MD or DO physician, for diagnosis, treatment, and ongoing medical management
- Take personal responsibility for implementing any suggestions or recommendations made during the program
Confidentiality
Dr. Katie Barbaccia, ND is committed to maintaining the confidentiality of all client information shared during the course of the program. Information shared in sessions and through intake forms will not be disclosed to third parties without your explicit consent, except where required by law.
Clients are also asked to respect the confidentiality of any group settings or community spaces associated with Radiant Vitality Collective, LLC offerings. Information shared by other participants in any group context should be treated with discretion and not shared outside of that setting.
Limitation of liability
To the fullest extent permitted by applicable law, Radiant Vitality Collective, LLC and Dr. Katie Barbaccia, ND shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of this website or participation in any program or service. This includes but is not limited to damages for loss of health outcomes, loss of income, or any other intangible losses.
The total liability of Radiant Vitality Collective, LLC for any claim arising out of or related to these Terms or any program or service shall not exceed the total amount paid by you for the program or service giving rise to the claim.
Indemnification
You agree to indemnify, defend, and hold harmless Radiant Vitality Collective, LLC, Dr. Katie Barbaccia, ND, and any of her agents, affiliates, or contractors from and against any claims, liabilities, damages, losses, or expenses, including reasonable legal fees, arising out of or related to your use of this website, your participation in any program or service, or your violation of these Terms.
Termination
Radiant Vitality Collective, LLC reserves the right to terminate your access to any program or service at any time if you violate these Terms, including but not limited to violations of the intellectual property provisions or the code of conduct outlined herein. Termination due to a violation of these Terms does not entitle you to a refund of any payments made.
Code of conduct
You agree to engage with Radiant Vitality Collective, LLC, its programs, and any associated community spaces with respect and professionalism. You agree not to engage in any behavior that is abusive, harassing, defamatory, or otherwise harmful toward Dr. Barbaccia, her team, or other clients. Radiant Vitality Collective, LLC reserves the right to remove any individual from its programs or community spaces in instances of misconduct, without refund.
No endorsement
References or links on this website to third-party information, programs, products, or services do not constitute a formal endorsement by Radiant Vitality Collective, LLC. You are responsible for using your own judgment when evaluating any third-party resource referenced on this website.
Governing law and dispute resolution
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising out of or related to these Terms or your participation in any program or service offered by Radiant Vitality Collective, LLC shall first be attempted to be resolved through good faith communication between the parties. If a resolution cannot be reached, disputes shall be subject to the exclusive jurisdiction of the courts located in the State of New York.
Severability
If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole. Such provisions shall be deleted without affecting the remaining provisions herein.
Entire agreement
These Terms, together with the Medical and Health Disclaimer and Privacy Policy published on drkatiebarbaccia.com, constitute the entire agreement between you and Radiant Vitality Collective, LLC with respect to your use of this website and participation in any program or service, and supersede all prior agreements and understandings with respect to the same.
Changes to these terms
Radiant Vitality Collective, LLC reserves the right to update or modify these Terms at any time. The date at the top of this page reflects the most recent revision. Continued use of this website or participation in any program following any update constitutes your acceptance of the revised Terms. For significant changes, reasonable efforts will be made to notify enrolled clients by email.
